PROJECT: STA202100002 Maintenance of improvements The Planning Commission will hold a public hearing to receive comments on a draft ordinance to amend Sec s. 14-235 (Effect of the approval of the private street), 14-303 (Content of the final dish) and 14-317 (Instrument attesting to the maintenance of certain improvements) of Chapter 14 (Subdivision of the land) of the County Code from Albemarle. This proposed ordinance would amend Sec. 14-235 (Effect of private street approval) by eliminating the current requirement that a developer submit a maintenance agreement for private streets. This proposed ordinance would also amend Sec. 14-303 (N) (Content of final dish) to require a declaration on the final dishes that private streets and other improvements will not be maintained by a public entity and must be maintained by the affected lot owners, and that the default maintaining the required improvements may be a violation of county ordinances. This draft ordinance would also repeal art. 14-317 (Instrument attesting to the maintenance of certain improvements).
